Welcome to AIatWork. By registering, subscribing, or accessing our platform, you agree to be bound by the following Terms of Service. These terms apply to all users, including individual subscribers (B2C) and corporate clients (B2B).

TERMS & CONDITIONS

1. INTRODUCTION AND SCOPE

1.1. These Terms and Conditions ("Terms") govern your use of AIatWork, a product owned and operated by Brainster, consisting of:

  • (A) AI Courses & AI Academies (delivered via the learning part of the AIatWork platform);
  • (B) AI Models (a unified interface to access third-party AI models); and
  • (C) AI Tools (AI-powered tools and workflows available within AIatWork).

Together, (A), (B), and (C) are referred to as the "Services".

1.2 Acceptance. By creating an account, subscribing, accessing, or using any part of the Services, you agree to these Terms.

1.3 Eligibility. You must be at least 16 years old to use AIatWork.

1.4 Changes. Brainster may update these Terms periodically. Brainster will update the "Last updated" date and, where changes are material, we may provide notice via the platform or email. Continued use after the effective date constitutes acceptance.

2. DEFINITIONS

2.1 "AIatWork" means Brainster's platform and associated content and functionality enabling access to the Services.

2.2 "AI Courses" means educational content with a duration of 60 minutes to 4 hours, delivered as stand alone standard or extended Sessions.

2.3 "AI Academies" means specialized educational programs with a continuous duration of at least six (6) weeks, featuring a set curriculum and schedule.

2.4 "AI Models" means a unified interface providing access to third-party Large Language Models (LLMs) such as OpenAI ChatGPT, Anthropic Claude, Google Gemini, Mistral, Perplexity, xAI Grok and DeepSeek. Brainster does not own the underlying models.

2.5 "AI Tools" means AI-powered software tools, workflows and utilities available within AIatWork that support specific tasks (e.g., automation, drafting, analysis, research, categorization, summarization, competitor analysis, governance/regulations support), whether developed by Brainster or integrated from third parties.

2.6 "User" ("you") means any natural person (B2C) or authorized employee of a company (B2B) registered on the platform.

2.7 "User Content" means any content you submit to AIatWork, including prompts, messages, files, course submissions, assignments, feedback, or other materials.

2.8 "Subscription" means a paid plan granting you access to AIatWork for a defined period and scope, as presented at checkout or in a separate agreement.

3. SERVICE STRUCTURE – THREE PARTS

AIatWork is separated into the following three parts. Each part has specific rules below, in addition to the general rules in these Terms.

  • PART A: AI Courses & AI Academies
  • PART B: AI Models
  • PART C: AI Tools

4. PART A – AI COURSES & AI ACADEMIES

4.1 Educational Service Description
AIatWork provides learning content through AI Courses and AI Academies delivered via the AIatWork learning platform.

4.2 Calendar, Schedule, Instructors
Each AI Course and AI Academy has a predetermined schedule and duration published on the platform. Brainster will publish the calendar (topics, dates, times, and instructors/service providers) in advance where reasonably possible.

4.3 Changes to Courses/Academies
Brainster may change the calendar, schedule, course topics, instructors/service providers, delivery format, or other elements after publication where reasonably necessary to improve quality, update content, address operational constraints, or ensure continuity.

4.4 Live Delivery and Recordings
As a general rule, Course sessions are delivered live online and recorded by Brainster. These recordings are stored and made available for user replay for a period of 48 hours following the session's conclusion. After this 48-hour window, access to the recording will expire. Academy sessions recordings are available to Academy enrolled participants for the full duration of the Academy

User recording, screen-capturing, reproducing, or redistributing session content is strictly prohibited without Brainster's prior written consent

4.5 Free Academy Benefit

Every user who activates a 6-month subscription or maintains an active subscription for at least six (6) consecutive months is eligible to receive one (1) AI Academy free of additional charge, chosen from the current offered selection. The user needs to be an active subscriber in the period when the chosen Academy takes place.

Each User may redeem a maximum of two (2) free AI Academies per calendar year if they have annual subscription or maintain an active subscription for at least twelve (12) consecutive months . Specific details regarding available academies and redemption processes are published on the platform.

4.6 Certificates and Assessments
Brainster may issue digital certificates for successful completion of an AI Course or AI Academy. To obtain a certificate, the User may be required to pass a quiz or assessment. Unless stated otherwise for a specific program, Users may have up to several attempts, and a passing grade may be set. Brainster may set different requirements per course/academy, as stated on the platform.

5. PART B – AI MODELS (UNIFIED ACCESS TO THIRD-PARTY MODELS)

5.1 Aggregator Role; No Ownership of Models
AIatWork AI Models provides a unified interface to access third-party AI models. Brainster does not own the underlying models.

5.2 Educational Purpose
You acknowledge that AI Models are an integral component of the broader AIatWork subscription and are provided primarily as a practical learning aid supporting AIatWork education.

5.3 Outputs May Be Incorrect; No Professional Advice
You acknowledge and agree that:
(a) AI-generated outputs may be inaccurate, incomplete, misleading, or inappropriate;
(b) AI Models do not provide professional advice (legal, medical, financial, or other);
(c) You are solely responsible for reviewing, verifying, and evaluating outputs before using them and for deciding how to rely on them;
(d) Brainster makes no warranties regarding accuracy, reliability, or suitability of AI outputs.

5.4 Commercial Use at Your Own Risk
AI Models are primarily designed for educational purposes. If you use them for professional or commercial tasks, you do so entirely at your own risk. The service is not intended for mission-critical business operations and Brainster is not liable for business losses, lost profits, or damages resulting from commercial reliance on outputs.

5.5 Model Availability and Limits
Brainster may add, remove, replace, or modify available models, features, and settings based on licensing, technical feasibility, or provider availability. Brainster may impose usage limits such as rate limits, fair-use limits, or monthly request caps to ensure stability and prevent misuse.

6. PART C – AI TOOLS (AI-POWERED TOOLS AND WORKFLOWS)

6.1 Description
AI Tools are AI-powered tools, workflows, and utilities available within AIatWork designed to support specific tasks and business processes (e.g., analysis, drafting, automation, categorization). AI Tools may be developed by Brainster and/or incorporated third-party components.

6.2 Educational Purpose; Commercial Risk
AI Tools are provided primarily as practical learning support within the AIatWork educational subscription. If you use AI Tools for professional or commercial tasks, you do so at your own risk. AI Tools are not guaranteed to be suitable for mission-critical operations.

6.3 Outputs and Responsibility
AI Tools may generate recommendations, drafts, analyses, and other outputs that may be incomplete or incorrect. You are responsible for verifying outputs before using them.

6.4 Availability and Limits
Brainster may update, expand, modify, add, remove, or replace AI Tools at any time. Brainster may impose reasonable usage limits to ensure stability and prevent abuse.

7. SUBSCRIPTION, BILLING, AND CANCELLATION

7.1 Subscription Plans
Available subscription plans (monthly, six-month, and annual) and included features are displayed at checkout, on the official AIatWork website, or within the specific B2B Service Agreement or B2B Terms & Conditions. Your access scope depends on the chosen plan.

7.2 Auto-Renewal and Seat Management

Subscriptions renew automatically to ensure uninterrupted access. To prevent automatic renewals and additional charges, a user is required to cancel their subscription before the current subscription period expires.

The subscription process varies by user type:

  • For Individual Subscriptions (B2C): Subscriptions renew on the same calendar day the prior period ends. If that day does not exist in the renewal month, renewal occurs on the last calendar day of that month.
  • For Business Subscriptions (B2B): Subscriptions for employees (users) remain active until the Administrative Contact removes the seat via the platform.
    • Deductions: To stop a subscription for the following month, the Administrative Contact must remove the seat by the last calendar day of the current month.
    • Additions: New seats added mid-month are charged proportionally (pro-rata) based on the remaining days in that calendar month.

7.3 Payments, Invoicing, and Currency

  • General: Prices may be shown in EUR for informational purposes, but transactions are processed in Macedonian Denars (MKD) at the middle exchange rate of the National Bank of North Macedonia on the date of issuance.
  • Individual (B2C): Payments are processed online via supported methods at the time of renewal.
  • Business (B2B): Invoices are issued monthly by the 5th day of the current month. Payment is due within seven (7) days of receipt. Payment may be made via:
    • Bank Transfer (to the accounts specified in the B2B Agreement or B2B Terms and Conditions).
    • Corporate Card deposited on the platform for automatic monthly charging.

7.4 Promotions

Brainster may offer discounts, free trials, free seats and subscriptions and special offers, or coupons under specific terms. Promotions are non-transferable and cannot be exchanged for cash.

7.5 Cancellation and Termination

  • Individual (B2C): You may cancel via account settings. Cancellation takes effect at the end of the current paid period. If a user cancels their subscription, they will retain access until the end of the paid period, and will not be charged for the subsequent billing cycle, but all progress on the platform will be lost. Alternatively, a user may pause their subscription for a period of one (1) or three (3) months; during which no charges will apply and all progress will be retained. At the end of the pause period, the subscription will automatically resume and the next billing cycle will be charged, unless the pause is canceled before it expires.
  • Business (B2B): Individual seats are cancelled by the Administrative Contact. The overall B2B Service remains valid as long as there are active seats, but may be terminated by either party via mutual or unilateral written notice. In case of unilateral termination, subscriptions for the current month must be fully paid.

7.6 Refunds

Payments are non-refundable except where required by mandatory law. In B2B cases, once an invoice is issued for active seats at the start of the month, the Service Recipient is liable for the full amount regardless of actual platform usage during that month.

7.7 Price Changes

Brainster reserves the right to change subscription prices. For B2B clients, price changes will be communicated to the Administrative Contact. Continued use of the platform or failure to remove subscription seats after the effective date of a price change constitutes acceptance of the new rate.

8. USER ACCOUNTS, SECURITY, AND PIN

8.1 Account Creation
Users must register and provide accurate, complete, and up-to-date information and keep it updated.

8.2 Non-Transferability
Accounts are personal and non-transferable. Sharing credentials is prohibited and may result in suspension or termination.

8.3 PIN (If Enabled)
If a PIN feature is enabled for protected chat access, you must keep your PIN confidential. Loss of the PIN may limit your ability to access protected content, subject to any recovery options offered in the platform.

8.4 Security
You are responsible for safeguarding your credentials. Notify Brainster promptly if you suspect unauthorized access.

9. ACCEPTABLE USE

You agree not to use AIatWork or any part of the Services:

  • in a way that violates laws or regulations (including data protection, export control, and sanctions);
  • to generate or share illegal, harmful, defamatory, harassing, hateful, discriminatory, or otherwise objectionable content;
  • to generate or distribute spam, malware, phishing, or malicious code;
  • to infringe IP rights, privacy, confidentiality, or other rights of others;
  • to reverse engineer, decompile, or attempt to derive source code or underlying models;
  • to bypass or interfere with security controls or usage limits;
  • to misrepresent AI-generated content as human-created where doing so would be deceptive or unlawful;
  • to submit personal data of others without a lawful basis and, where required, valid consent;
  • to upload or disclose confidential business information or trade secrets unless you have the right to do so and accept all related risks.

Brainster may suspend or terminate access if it reasonably believes you violated this section.

10. USER CONTENT AND LICENSE

10.1 Your Ownership
You retain ownership of your User Content.

10.2 License to Brainster (to Operate the Services)
You grant Brainster a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and use User Content as necessary to:

  • provide the Services to you (including routing prompts/content to Model Providers and/or third-party components you use);
  • maintain security and prevent abuse;
  • troubleshoot and provide support;
  • comply with legal obligations.

10.3 Training
Brainster does not use your prompts, chats, uploaded files, or User Content to train Brainster's own AI tools and AI models.

10.4 Feedback
If you provide feedback, suggestions, or ideas, you grant Brainster a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use such feedback to improve the Services.

11. THIRD-PARTY PROVIDERS AND TERMS

11.1 Integration and Acceptance of Terms of Terms

AI Models and AI Tools within the platform rely on third-party providers (including, but not limited to, OpenAI, Google, Anthropic, and others). By using these tools, Users and Service Recipients acknowledge and agree to be bound by the respective terms of service and privacy policies of these third-party providers.

11.2 Data Processing and User Content and User Content

Brainster is not responsible for, and has no control over, how third-party providers process, store, or utilize User Content (prompts, data, or uploads) once transmitted to their systems. Users are encouraged to review third-party policies and avoid entering sensitive, confidential, or proprietary information into AI models.

11.3 Availability and Content and Content

Brainster is not responsible for the uptime, availability, or accuracy of the outputs generated by third-party services, except as required under applicable mandatory law or specific contracts with those providers.

11.4 Modification of Providers of Providers

Brainster reserves the right to replace, add, or remove third-party providers or specific AI models at any time based on technical, licensing, or commercial considerations without prior notice.

12. INTELLECTUAL PROPERTY

12.1 Brainster Ownership

Except for User Content, all intellectual property in AIatWork and its content—including software, UI design, curricula, educational materials, graphics, logos, trademarks, and audio/video content—is owned by Brainster or its licensors. This ownership is protected by copyright and intellectual property laws.

12.2 License to Use

Brainster grants you (or the Service Recipient's authorized users) a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for personal or internal business training purposes during an active subscription.

12.3 Restrictions and Prohibited Acts and Prohibited Acts

The following actions are strictly prohibited without Brainster's prior written consent:

  • Unauthorized Reproduction: You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from AIatWork content.
  • Commercial Exploitation: You may not resell the Services or use the platform content for any commercial purpose outside of internal employee training.
  • Recording & Capture: User recording, screen-capturing, or archiving of live sessions or replay content is strictly prohibited. As per Article 4.4, any provided session recordings are for temporary viewing only (typically 48 hours) and may not be downloaded or redistributed.

13. DISCLAIMERS

13.1 General Basis

The Services are provided on an "as is" and "as available" basis. Use of the platform is at your own risk.

13.2 Service Availability and Limits and Limits

Brainster may suspend or discontinue any part of the Services and may impose limits on the number of monthly requests/prompts per user where reasonably necessary (e.g., for security, legal compliance, system stability, or third-party provider constraints). Brainster does not guarantee uninterrupted or error-free operation, particularly regarding disruptions caused by third-party LLM providers or global internet outages.

13.3 Disclaimer of Warranties

To the maximum extent permitted by law, Brainster disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

13.4 AI-Generated Output Accuracy Accuracy

Brainster does not warrant the accuracy, reliability, or legality of any content or answers generated by AI Models and Tools. All AI-generated outputs should be independently verified by the User or Service Recipient before being applied to business processes or decision-making. Brainster is not liable for any errors or "hallucinations" produced by the underlying third-party technology.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

(a) Excluded Damages

Brainster shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of revenue, business interruption, loss of data, or loss of business opportunities arising out of or related to the use of the AIatWork platform.

(b) Total Aggregate Liability

Brainster's total aggregate liability for all claims arising out of or relating to these Terms or the use of the Services—whether in contract, tort, or otherwise—is limited to the total amount of fees paid by you to Brainster in the one (1) month preceding the event giving rise to the claim.

(c) Free Services and Add-ons

If a specific Service or feature (such as the Free Academy Benefit) is provided to you free of charge or as a free add-on, Brainster's total aggregate liability regarding that specific Service is limited to EUR 29.

15. SUSPENSION AND TERMINATION

Brainster may suspend or terminate access to AIatWork if:
(a) you materially or repeatedly breach these Terms;
(b) Brainster is required to do so by law or a third-party provider;
(c) Brainster decides to discontinue AIatWork or a material part of it;
(d) your use creates security, legal, or operational risk.

Upon termination, your license ends immediately. Sections that by their nature should survive (IP, disclaimers, limitation of liability, governing law) remain applicable.

16. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Republic of North Macedonia. Disputes are subject to the competent courts in Skopje, North Macedonia, unless mandatory consumer law provides otherwise.
